WHAT IS THE H2B VISA PROGRAM?

An H-2B visa is one type of visa that allows people from other countries to live and work in the United States. It was established along with other visas through an amendment to the Immigration and Nationality Act of 1952.  H-2B visas are employment visas granted to foreign workers for non-agricultural, seasonal jobs. The visa expires at the end of the agreed upon duration, and at that time, the worker must return to his or native country.

The Department of Homeland Security (DHS), U.S. Citizenship of Immigration Services (USCIS), Department of Labor (DOL), and Department of State (DOS) all play a role in the H-2B visa program.

THE H-2B HASSLE

If you are a contractor who has applied for or used the H-2B visa program in the past, you know that it is not a guarantee and involves an exhaustive application process.

First, contractors must prove to the DOL an inability to staff a temporary project with qualified workers. If they meet that requirement, contractors file a petition to the DHS for the number of workers they want for the upcoming season.
